EDIS helps client claim thousands owed

One phone call to JobWatch’s TIS, and a few phone consultations with a JobWatch lawyer through our EDIS service allowed our client to claim thousands of dollars of monies owed to her, as well as secure a higher wage into the future – an excellent result!

Our Employment Documents Interpretation Service (EDIS) provides legal advice and support interpreting any document related to employment or work for all Victorian workers. This includes modern awards, enterprise agreements, employment or other contracts, employer policies and other legal documents.

David recently used our EDIS service when he called our Telephone Information Service (TIS) with concerns about proposed changes to his 20 year old daughter’s existing employment contract. These included the removal of annual leave loading without any compensation, amendment of a travel allowance, and a Restraint of Trade clause for six months after leaving the company.

Our TIS phone consultant referred David to our EDIS service, where a JobWatch lawyer reviewed the proposed contract in full and provided advice through several consultations on his daughter’s entitlements and how to respond to her employer.

With our support, David’s daughter was able to confidently negotiate the terms of her new contract. As a result, she:

  • received all the accumulated leave loading that she was owed;
  • received an increase to her ongoing hourly rate to compensate for the removal of leave loading in the future;
  • received all the travel allowance that she was owed for previous overnight travel; and
  • got confirmation that the Restraint of Trade clause would not apply to her if she was to leave and work in a similar role for a competitor.

Do you need the EDIS service as well?

Victorian workers can call JobWatch’s Telephone Information Service on (03) 9662 1933 (Melbourne Metro) or 1800 331 617 (Regional Victoria) and ask for EDIS. You will be asked to email the document to us for review.

Once you send us the document, a JobWatch lawyer will read and interpret the document. We will meet or call you to provide legal advice.

Note – Employees who have been dismissed have only 21 days to file an unfair dismissal or general protections claim from the date their dismissal took effect – so act quickly and call us now!
