Workplace Sexual Harassment and Non-Disclosure Agreements in Victoria

This Fact Sheet discusses the new non-disclosure agreement law for sexual harassment cases, which commenced in Victoria on 1 July 2026.

A non‑disclosure agreement (NDA) is:

  • any agreement (or part of an agreement)
  • that tries to stop a worker from sharing information or speaking about workplace sexual harassment

The new law introduces a number of new rules which restrict the use of non-disclosure agreements.
